PHOENIX — An Arizona appeals court has quashed the ten-and-a-half-year sentence of Gabriel Paul Horcasitas, convicted of manslaughter in the 2021 road rage killing of Christopher Pelkey in Chandler. The defect, the court found, was participation. At the 2025 sentencing hearing, the victim's sister, Stacey Wales, presented a video in which Pelkey — rebuilt by artificial intelligence from his image and voice — addressed the court and said he forgave the man who shot him. The court ruled that airing the message from the dead man "crossed that line." The sentence was voided and the case returned for resentencing.

The transaction, as filed, reads cleanly. Pelkey paid in full and in advance: one life, tendered without consent, non-refundable. His family paid in grief and again in production, commissioning the rendering. Horcasitas was billed ten and a half years. The state paid courtroom hours. The appeals court audited the invoice and disallowed a single entry: the deceased.

"We logged the deceased as a visual aid," said Rondell Fitzhugh, Deputy Administrator of Sentencing Exhibits for Maricopa County. "Visual aids are billed to the presenting party. Nobody billed the deceased. That is where the file went wrong."

"A victim impact statement is free," said Dana Okafor-Prill, a Phoenix appellate attorney who has followed the file. "A statement delivered by a rebuilt victim is a production. Productions have budgets. The court does not budget for resurrection, so it struck the line." The quashing was, on this reading, not a ruling on mercy. It was a pricing decision: the deceased had been entered on the invoice without authorization.

The arithmetic the court objected to is exact. The rendering forgave the killer. The judge, presented with a dead man's forgiveness, set the price of the killing at ten and a half years. The appeals court found the deceased lacked standing to sway the valuation and ordered the bill re-cut without him. Horcasitas now waits to be re-priced. His account with the state — an institution licensed to store numbers — remains open pending the recount.

The ledger balances. It balances because the only creditor with no address at which to file an objection has been struck from it. The killing remains on the books at an amount to be determined. The dead man's forgiveness has been removed for accuracy.
