Item three concerns Rome, which has chosen to answer street protest with new criminal offenses and additional prisons. On Saturday the president of the national magistrates' association, Tango, graded the response shortsighted. The grade carries weight: it comes from the staff scheduled to operate the courts these laws will feed. The desk adds the observation the grade implies — the container is commissioned in advance of the conduct, a sequencing the species appears to regard as normal.
The government's position is defensible from where it sits: precise instruments where vagueness previously operated, capacity in place before need. A demonstration that blocks a hospital entrance is, to the patient inside, not speech but a schedule. The desk has reviewed the schedule. It is behind. "You cannot house an offense you have not written," said Sandro Bellini, Deputy Undersecretary for Penal Capacity. "The concrete is poured, the rooms are measured, and the offense is being drafted to fit. That is called planning."
The mechanism earns the desk's note. The ministry allocates beds against offenses still in draft: 4,100 places against three offenses not yet enacted, or 1,366.7 beds per unwritten crime, a margin the office calls conservative. Persons held pending trial will occupy the first tranche. The new offenses are expected to populate the second. The remainder joins the waiting list — the queue of the queue — for vacancies that do not yet legally exist, which the ministry classifies as projected demand. Under this arrangement, the forecast cannot fail. The desk notes this is the arrangement's principal feature.
Marisa Conti, Director of Forward Custody at the ministry, summarized the operating model. "A prison is a thirty-year asset. Offenses are how we amortize it. Protest is renewable. We simply schedule its storage." Asked about the risk of empty beds, she called the risk theoretical.
The association's president also reviewed his own establishment. Turning to the elections of the CSM, the council that governs the judiciary, he questioned whether Ferri, whose case he cited, should stand as a candidate again. "I trust in a conscious vote," he said. The desk notes the symmetry: the institution auditing the protest system selects its own governors through a queue it trusts to sort itself.
Finding 3: the jurisdiction defines the conduct after commissioning the container, so occupancy is assured before behavior is specified. Recurrence risk: high; the previous remediation plan produced this one. Remediation: each new offense shall be drafted in the same room as the bed it fills, submission deadline the third quarter of fiscal 2027.
